1. INTRODUCCIÓN
Las redes empresariales son una forma difundida de cooperación en Europa, no solo para las pequeñas y medianas empresas (PYMEs)252, sino también para él a veces descuidado grupo de las empresas de rango medio.253 Por el contrario, las grandes empresas a menudo no ven la necesidad de cooperar con socios en el marco de una red empresarial. Incluso si están dispuestas a unirse a una red empresarial, la legislación antimonopolio europea y nacional (Cf. art. 101 TFUE y § 1 ley antimonopolio alemana) prohíbe la mayoría de las formas de participación que son interesantes para las grandes empresas desde el punto de vista económico.254 Una de las pocas oportunidades interesantes para las grandes empresas es la investigación conjunta en base a cooperaciones, ya que la ley de defensa de la competencia es menos estricta con respecto a este aspecto.
A pesar de ser un instrumento ampliamente utilizado, las redes empresariales hasta el momento no han sido totalmente comprendidas desde una perspectiva jurídica.
