1 En 2000, de los nueve países con mayor inequidad en el ingreso en el mundo, siete eran latinoamericanos. De acuerdo con el Banco Mundial, los países sub-Saharianos y latinoamericanos tienen los más altos índices de desigualdad en el mundo, con un coeficiente Gini por encima del 0,50 desde los años sesenta (véase United Nations Development Program 2002: 183; Guillermo Perry et ál. 2006: 53).
2 Mauricio Funes, del Frente Farabundo Martí para la Liberación Nacional (FMLN) –partido que surgió del grupo guerrillero de izquierda–, ganó las elecciones presidenciales en marzo 15 de 2009, derrotando así al partido conservador Alianza Republicana Nacionalista (ARENA), que había gobernado al país desde el fin de la sangrienta guerra civil en 1992.
3 El caso de Chile es ilustrativo: con el retorno de la democracia después de una dictadura militar que duró 16 años (de 1973 a 1989) y que implantó un modelo económico neoliberal, gobiernos social-demócratas han dominado la escena política. No obstante, la victoria del multimillonario Sebastián Piñera en las elecciones presidenciales del 17 de diciembre de 2010, marcó el regreso de la derecha al gobierno del país. 4 De acuerdo con Dezalay y Garth, el consenso de Washington es “una frase desarrollada en 1990 para sugerir que el gobierno de los Estados Unidos y las organizaciones multilaterales en Washington han llegado a un acuerdo sobre qué tipo de Estado y economía serían apropiados para América Latina” (Dezalay y Garth [eds.] 2002: xv).
5 Los Estados Unidos es el caso arquetípico, seguido por el Reino Unido, Australia, Nueva Zelandia y Sudáfrica (Cavadino y Dignan 2006: 441). En América Latina, países como Colombia, México, Perú, El Salvador, Panamá, e incluso Chile y Brasil, encajan en este modelo.
6 Los Estados Unidos y el Reino Unido evidencian preocupantes niveles de desigualdad y exclusión social. En los Estados Unidos, una tercera parte de la riqueza pertenece al 1% de la población. El 95% del aumento de la riqueza entre 1979 y 1996 ha beneficiado al 5% más rico de la población (Young 1999: 28; Wacquant 2000: 78). En el Reino Unido, la desigualdad en el ingreso también ha aumentado notablemente en las últimas dos décadas: un 28% (frente a un 24% en los Estados Unidos). Más de la mitad de la riqueza del país le pertenece al 1% más rico de la población británica (Reiner 2007: 4).
7 Según el coeficiente de Gini de la Organización de Naciones Unidas (ONU), en el 2000 Colombia era el noveno país en el mundo por reparto más desigual de la riqueza (UNDP 2002: 183). Según el Departamento Nacional de Planeación (DNP)y el Departamento Administrativo Nacional de Estadística (DANE 2009), en 2005 el 50,3% de la población colombiana se encontraba en situación de pobreza y el 15,7% en situación de indigencia.
8 Tanto en criminología como en sociología se viene dando una gran discusión sobre el Estado neoliberal, sus características y su relación con un sistema penal altamente punitivo y excluyente. El reciente libro de Loïc Wacquant, Punishing the Poor. The Neoliberal Goverment of Social Insecurity (2009), ha generado un gran debate internacional al respecto. Por ejemplo la revista Theoretical Criminology, vol. 14, núm. 1, 2010, publica artículos de autores de diversos países, quienes discuten críticamente la propuesta de Wacquant.
9 Wilkinson y Picket presentan abundante evidencia empírica que demuestra que aquellas sociedades caracterizadas por altos niveles de desigualdad económica y social, no sólo presentan mayores niveles de violencia, sino también sistemas penales más punitivos (con altas tasas de encarcelamiento que han aumentado notablemente en las últimas dos décadas) (2010: 145-156).

11 Por supuesto, no son las únicas ni las más importantes. Algunos estudios se basan en la permeabilidad de las instituciones de confinamiento, es decir, qué tan vulnerables son a las influencias exteriores y en qué medida reproducen sus estándares (Goffman 1961b: 28). Otros hacen énfasis en la prisión como una extensión de la red urbana de control social (Pavarini 1995; Cohen 1994), mientras que otros, con base en perspectivas fenomenológicas, indagan por las estrategias individuales para “ajustarse” al mundo del encierro (Goffman 1961a; Adams 1992; DeRosia 1998).

14 Zaffaroni (1990) establece tres tipos ideales de prisiones en América Latina. El primero puede ser definido como la cárcel gueto, esto es, instituciones que resultan similares a los barrios pobres y en las cuales las personas presas mantienen relaciones fluidas con el exterior; el segundo es definido como cárcel-campo de prisioneros, es decir, instituciones que únicamente tienen como propósito contener y aislar a las personas presas en condiciones infrahumanas. Por último, las cárceles hotel, lugares de reclusión financiados, generalmente, por personas presas con alto capital económico y que aseguran condiciones de vida relativamente cómodas (Zaffaronni 1990). Para un análisis etnográfico de siete prisiones colombianas ver CIJUS (2000) y Ariza (2010) para una etnografía sobre la prisión Modelo. Carrillo, en su etnografía de la prisión colombiana La Modelo, hace evidente la situación de semejanza entre los espacios de reclusión y los espacios urbanos para las personas presas pobres en los siguientes términos: “Estos patios se asemejan a barrios como Las Cruces o a cualquiera de los barrios de Ciudad Bolívar” (2001: 153).
